Proposed Revisions to 940.8 - Student Activity Fees

Attorney General opinion:

           "Mandatory university system student fees are public funds and must be expended for a public purpose determined in the first instance by the Montana board of regents."  Opinion #74, March 20, 1974.

Board policy:

            1.         Student activity fees at unitscampuses of the Montana University System, as established by prior action of the Board of Regents, shall not be considered as earmarked funds in Board policy. It is intended that budget allocations shall be established by officers of the respective student government associations pursuant to the Associated Students Constitution of the unitscampuses as approved by the presidents of said units president or chancellor.  No impairment of existing contractual obligations shall occur. Unit presidents shall establish administrative policies and copies shall be filed in the Office of the Commissioner of Higher Education.

            2.         Students enrolled in the Law School are exempted from paying the regular student activity fee.  Such students shall, however, pay the Law School activity fee as provided by Item 210-108, April 14, 1969.
