MANAGEMENT RIGHTS
3.1 MANAGEMENT RIGHTS
Employees and the bargaining agent recognize the prerogative of the employer, subject to the
terms of this agreement, to operate and manage its affairs in such areas as, but not limited to:
- directing employees;
- hiring, promoting, transferring, assigning, and retaining employees;
- relieving employees from duties because of lack of work or funds or under
conditions where continuation of such work would be inefficient or
nonproductive;
- maintaining the efficiency of the employer's operations;
- determining the methods, means, job classification, and personnel by which the
employer's operations are to be conducted;
- taking whatever actions may be necessary to carry out the missions of the
employer in situations of emergency; and
- establishing the methods and processes by which work is to be performed.

All rights and prerogatives of the employer which are not specifically relinquished in this
agreement shall be retained by the employer. The right of the employer to promulgate and
enforce reasonable work rules is expressly recognized.
