A. Classified employees shall participate in the defined benefit or the defined contribution plan administered by the Public Employees Retirement System in accordance with state law. Classified employees also have the option to participate in the Optional Retirement Program (ORP).

B. Professional and administrative employees with individual contracts under the authority of the Board of Regents shall participate in the ORP unless they have prior service in the Teachers Retirement System or the Public Employees Retirement System. Employees with prior service in another public employees retirement system may elect to continue participation in the other retirement system as long as such participation is consistent with state statute and retirement system eligibility criteria. Retirement eligibility and benefits are administered in accordance with state law.
